These Terms of Service (“Terms”) govern access to https://www.dawnlamps.com/ and purchases from Dawn Lamps, an online store operated by dawnlamps LLC. By using the website, creating an account, or placing an order, you agree to these Terms. If you do not agree, do not use the website or submit an order.
1. Business Identity
Dawn Lamps is the customer-facing brand used on dawnlamps.com. The legal entity operating the store is dawnlamps LLC, 521 E 14th Ave, Unit 26, Denver, CO 80203, United States.
2. Eligibility and Lawful Use
You must be legally capable of entering a binding contract in the place where you live. You may use the website only for lawful purposes and in accordance with these Terms.
3. Accounts
You are responsible for keeping account credentials confidential and for information submitted through your account. Notify us promptly if you suspect unauthorized access. We may suspend an account used for fraud, abuse, unlawful activity, security interference, or a material violation of these Terms.
4. Product Information
We make reasonable efforts to display accurate product titles, photographs, prices, availability, dimensions, materials, finishes, electrical specifications, installation information, and policies. Photography, screen settings, handmade production, verified natural materials, measurement methods, and reasonable manufacturing tolerances may cause limited variation.
A product’s material facts and available specifications are stated on its product page. Contact us before ordering if a project-critical detail is unclear. An omission or reasonable request for clarification does not remove any non-waivable consumer right.
5. Availability and Order Acceptance
Products in a cart or wishlist are not reserved. An automated order confirmation acknowledges receipt of the order and does not necessarily mean final acceptance. We may decline or cancel an order before dispatch because of unavailability, a material pricing or description error, payment failure, suspected fraud, shipping restriction, quantity limitation, or inability to verify information. If we cancel a paid order, we will refund the amount collected for the canceled item.
6. Prices, Promotions, and Taxes
Unless otherwise displayed, prices are in U.S. dollars. Prices, promotions, and availability may change before an order is accepted. Discount codes are subject to the conditions shown with the offer. Applicable sales tax is calculated during checkout where required.
7. Payment
Payment is governed by the Payment Policy. The customer authorizes the selected payment provider and Dawn Lamps to process the total displayed at checkout. We may request reasonable verification before accepting or dispatching an order.
8. Processing, Shipping, and Delivery
Processing, shipping cost, estimated delivery, tracking, split shipments, delivery problems, and address responsibilities are governed by the Shipping Policy. Delivery dates are estimates and may be affected by circumstances outside our reasonable control.
9. Changes and Cancellations
A request to change or cancel an order is effective only when Dawn Lamps confirms it in writing. An order that has entered irreversible processing, packing, or dispatch may not be changed or canceled. An order that has shipped is handled under the Return & Refund Policy.
10. Returns and Refunds
Return eligibility, return shipping, refund timing, exclusions, and damaged-product procedures are governed by the Return & Refund Policy. All returns require written authorization before shipment.
11. Warranty
Eligible products are covered only as stated in the Warranty Policy and any additional written warranty supplied with the product. The Warranty Policy is incorporated into these Terms.
12. Installation and Safety
Hardwired lighting must be installed by a qualified electrician in accordance with product instructions and applicable codes. Before installation, the customer and installer must confirm structural support, ceiling capacity, voltage, wiring, junction-box suitability, bulbs, dimmers, moisture rating, and environmental conditions. Do not install or energize a damaged, incomplete, or apparently unsafe product.
To the extent permitted by law, Dawn Lamps is not responsible for injury, property damage, or product damage caused by improper installation, unsuitable building conditions, incompatible electrical components, unauthorized modification, or use outside the product’s stated rating.
13. Reviews and Customer Content
If you submit a review, photograph, video, design image, or other content, you confirm that you have the right to submit it and that it does not violate another person’s rights or applicable law. You grant dawnlamps LLC a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, and display that content for customer service, website operation, marketing, and business records. This license does not transfer ownership of your content.
We may remove content that is unlawful, misleading, abusive, infringing, irrelevant, fraudulent, or contains private information.
14. Intellectual Property
The website and its original text, design, graphics, logos, photographs, videos, and code are owned by or licensed to dawnlamps LLC. Except for ordinary personal use of the website, they may not be reproduced, republished, modified, distributed, sold, or commercially exploited without written permission.
15. Prohibited Conduct
You may not use false identity, payment, address, or transaction information; attempt unauthorized access; introduce malware; interfere with website security, checkout, pricing, or reviews; infringe another person’s rights; or falsely represent an affiliation with Dawn Lamps.
16. Third-Party Services
Payment providers, carriers, analytics services, social platforms, and linked websites operate under their own terms and policies. We are not responsible for a third party’s independent acts, outages, content, or data practices.
17. Website Disclaimer
To the extent permitted by law, the website is provided on an “as available” basis. We do not promise that every feature will be uninterrupted, error-free, or compatible with every device. Product warranties are limited to the written Warranty Policy and any non-waivable warranties provided by law.
18. Limitation of Liability
To the fullest extent permitted by law, dawnlamps LLC will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses arising from website use, delayed delivery, product selection, or product use. For a claim directly arising from a purchased product, our aggregate liability will not exceed the amount paid for the product giving rise to the claim, except where applicable law does not permit that limitation.
Nothing in these Terms limits liability that cannot legally be limited or excludes a non-waivable consumer right.
19. Governing Law
These Terms are governed by the laws of the State of Colorado and applicable federal law, without regard to conflict-of-law rules. Mandatory consumer protections in a customer’s jurisdiction remain applicable where they cannot be waived.
20. Severability and No Waiver
If a provision is found unenforceable, the remaining provisions continue in effect to the extent legally possible. Failure to enforce a provision on one occasion is not a waiver of the right to enforce it later.
21. Changes to These Terms
We may update these Terms to reflect operational, legal, or service changes. Updated Terms become effective when posted with a revised date. The Terms in effect when an order is accepted will generally govern that transaction, except where applicable law requires otherwise.
